General Conditions of Sale
Article 1: Definitions
“Client” = means any natural or legal person, consumer or professional who subscribes to a service offered by Valentin FAIVRE PIERRET EI.
“Seller” = the sole proprietorship Valentin FAIVRE PIERRET EI
The “site” = the website www.montbaluchon.com
Article 2: The company Valentin FAIVRE PIERRET EI
Mont Baluchon is a brand of the individual company Valentin FAIVRE PIERRET located at 6 rue Abbé Sieyès 25000 Besançon, registered under SIRET number 92194214000010.
Valentin FAIVRE PIERRET EI offers a program containing two types of services:
A Travel Planner service.
A Neuro Coaching service, outsourced and provided by a professional: Anahé RABELO, Neuro Coach Certified by Life In Balance Careers.
Article 3 : Champ d’application
These general terms and conditions of sale constitute the rights and obligations between Valentin FAIVRE PIERRET EI and the Client within the framework of their commercial relations; they apply to all services provided by Valentin FAIVRE PIERRET EI to its Clients.
When validating the order, the Customer declares having read these General Conditions of Sale and explicitly accepts them through the act of purchase. Thus, the commercial relationship is subject to the conditions in force at the time of the first payment of the order.
Article 4: Characteristics of the services
Mont Baluchon is a coaching program including Travel Planner and Neuro Coaching services:
Coaching: is defined as supporting a person on a personal and/or professional level, towards their autonomy and in a dynamic of change. Coaching is a process based on a collaborative relationship. It is centered on objectives to be achieved to allow a person to develop their potential, increase their level of performance and take action.
Travel Planner: Creation of tailor-made travel itineraries and travel advice in order to achieve the client's objective.
The Client understands that Mont Baluchon does not constitute a tourist package or a so-called "packaged" offer. The Company therefore does not need to be registered in the register of travel operators.
Neuro Coaching: delivered by certified Neuro Coaches, the aim of which is to support the Client in order to optimize their personal practice as well as the development of skills, know-how and interpersonal skills.
The Client understands that coaching is not therapy and is not a substitute for therapy if needed, nor does it prevent, cure or treat any mental disorder or medical illness. The Client further acknowledges that he or she may terminate or discontinue the coaching relationship and training at any time.
Article 5: Conditions of sale
Prices are available on the website, the customer fills out a form containing the various essential information for creating their quote. These prices are communicated in euros and are exempt from VAT.
Article 6: Information relating to the order
Before subscribing to a service, the Customer benefits from all the information available on the website www.montbaluchon.com, including the General Conditions of Sale. He can also request a free videoconference interview to obtain all the desired answers.
Article 7: Validation of the order
The sale is finalized when the Customer makes the first payment for the service.
Article 8: Methods and conditions of payment
Payments are made by bank transfer and/or credit card directly from the website or through a STRIPE payment link. The Seller allows the Customer to pay in one or more installments.
In the case of a one-off payment, the total amount of the quote must be paid at the time of signing the quote.
In the case of payment in several installments, the total amount of the quote is divided into two or three installments depending on the offer selected. The first installment being at the time of signing the quote.
In the event of late payment, the Seller reserves the right to suspend the service and refuse any new orders until payments are honored.
In accordance with the law, any amount not paid within thirty days after the payment deadline will be subject to a late payment penalty at a rate equal to three times the legal interest rate in force as well as a fee of 30 euros.
Article 9: Conditions for the execution of service provision
The service is provided exclusively in an online format via videoconference.
The service provision takes effect on the date stated on the quote and ends at the time of the final debriefing session.
Article 10: Right of withdrawal for distance purchases
As mentioned in the articles of law below, from the signing of the contract the Customer has fourteen days to withdraw without having to justify his choice. On the other hand, if the service has already been consumed, withdrawal is no longer possible.
If the customer exercises his right of withdrawal, the reimbursement will be made by bank transfer within thirty days from the written request of the Customer.
Article L221-1 of the Consumer Code: “any contract concluded between a professional and a consumer, within the framework of an organized system of sale or provision of services at a distance, without the simultaneous physical presence of the professional and the consumer, by the exclusive use of one or more remote communication techniques until the conclusion of the contract”.
Article L221-18 of the same code: "The consumer has a period of fourteen days to exercise his right of withdrawal from a contract concluded remotely, following telephone or off-premises canvassing, without having to justify his decision or bear costs other than those provided for in Articles L. 221-23 to L. 221-25. The period mentioned in the first paragraph runs from the day: 1° Of the conclusion of the contract, for contracts for the provision of services and those mentioned in Article L. 221-4; 2° Of the receipt of the goods by the consumer or a third party, other than the carrier, designated by him, for contracts for the sale of goods. For contracts concluded off-premises, the consumer may exercise his right of withdrawal from the conclusion of the contract."
However, under the terms of Article L 121-20-2, 1° of the Consumer Code, the right of withdrawal can no longer be exercised once the Customer has accessed the Services concerned or used the product. Any costs are the responsibility of the Customer.
Article 11: Evolution of the general conditions of sale
The General Conditions of Sale may be modified at any time to evolve with the Seller's activity.
The Customer remains subject to the conditions in force at the time of purchase.

Article 13: Intellectual property
L’ensemble des données du site internet, photos, vidéos, logos, chartes graphiques, connaissances sont de la propriété intellectuelle de l’entreprise individuelle Valentin FAIVRE PIERRET.
Toutes les données et connaissances acquises lors des sessions de Neuro Coaching sont de la propriété intellectuelle de Anahé RABELO, et de MINDSET ACT IE ou de tout autre Neuro Coach effectuant le coaching.
Toute exploitation ou reproduction, totale ou partielle du contenu du Site ou des Services est strictement interdite et peut donner lieu à une action en concurrence déloyale.
Tout le contenu vendu au Client est délivré à titre strictement personnel. Le Client n’est pas autorisé à céder, communiquer ou partager les informations s’y trouvant. En cas de transgression de cette règle, le Client engage sa responsabilité et s’expose à des sanctions.
Article 14: Disputes
To resolve any disputes that may arise as a result of non-compliance with the General Terms and Conditions of Sale by the Customer or the Seller, an amicable solution is preferred. The dispute may be communicated by e-mail to the Seller at infos@montbaluchon.com or by post: Valentin FAIVRE PIERRET, 6 rue Abbé Sieyès 25000 Besançon.
Where applicable, the settlement of disputes falls within the jurisdiction of the Court of the registered office of Valentin FAIVRE PIERRET EI.
Article 15: Liability
Le client est seul responsable de la création et de la mise en œuvre de son propre bien-être physique, mental et émotionnel, de ses décisions, choix, actions et résultats découlant ou résultant de la relation de coaching et de la formation de coaching. En tant que tel, le client accepte que le coach ne soit pas et ne sera pas responsable de toute action ou inaction, ou de tout résultat direct ou indirect des services fournis par le coach.
